1. Acceptance of Terms

Techmert is not the manufacturer, importer, distributor, or installer of products listed by suppliers unless expressly stated. Contracts for the sale of goods are formed directly between the buyer and the supplier.
3. Supplier Responsibility
Suppliers are solely responsible for the accuracy, legality, pricing, availability, compliance, safety, product descriptions and intellectual property rights relating to their listings. Techmert does not independently verify or review all supplier content and makes no warranties regarding supplier listings. Suppliers warrant that their products comply with all applicable Australian laws, including Australian Consumer Law and product safety regulations.
4. Buyer Responsibility
Buyers are responsible for assessing product suitability before purchase. Buyers acknowledge that product specifications and representations are provided by suppliers. Techmert is not liable for inaccuracies in supplier content.
5. Orders and Contract Formation
When a buyer places an order, the order is transmitted to the supplier for acceptance and fulfilment. Techmert reserves the right to cancel or suspend orders in cases of suspected fraud, system error, pricing error, or legal concerns. Acceptance of an order does not occur until confirmed by the supplier.
6. Pricing and Listing Errors
Suppliers are responsible for ensuring pricing accuracy. Techmert is not liable for pricing errors, typographical errors, or incorrect product information uploaded by suppliers. In the event of an obvious error, Techmert reserves the right to cancel affected orders.
7. Payment Processing
Payments may be processed through third party payment providers. Techmert does not store full payment information. By making a payment, you agree to the terms of the relevant payment processor.
8. Delivery and Fulfilment
Suppliers are responsible for fulfilment, shipping and delivery timelines. Delivery estimates are indicative only. Techmert is not liable for supplier delays, logistics issues, or transport related damage unless required by law.
9. Returns and Warranty
Warranty terms are provided by the supplier unless otherwise stated. Claims relating to defects, returns or warranty must be directed to the supplier. Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.
10. Intellectual Property
All platform content, branding, website design and intellectual property belonging to Techmert remains the property of Techmert. Suppliers retain responsibility for ensuring they have rights to product images and descriptions they upload. Suppliers indemnify Techmert against claims arising from intellectual property infringement.
11. Indemnity
Suppliers agree to indemnify and hold harmless Techmert, its directors, officers and affiliates from any claims, losses, damages, liabilities, costs or expenses arising from supplier products, listings, regulatory breaches, product defects, intellectual property claims or failure to comply with applicable laws.
Buyers agree to indemnify Techmert against misuse of the platform or breach of these Terms.
12. Limitation of Liability
To the maximum extent permitted by law, Techmert excludes all liability for indirect, incidental or consequential loss arising from use of the platform. Where liability cannot be excluded under Australian Consumer Law, Techmert’s liability is limited to the extent permitted by law.
13. Account Suspension
Techmert reserves the right to suspend or terminate accounts that breach these Terms, provide false information, engage in unlawful activity or damage the integrity of the platform.
14. Privacy
Use of the platform is also governed by our Privacy Policy.
15. Amendments
